Terms of Service

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

To use the Service, you must create an account by authenticating through Google OAuth. You agree to:

• Provide accurate and complete information through your Google account.
• Maintain the security of your Google account credentials.
• Immediately notify us at [email protected] of any unauthorized use of your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

You agree not to use the Service to:

• Create links to content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Distribute malware, viruses, phishing pages, or any other malicious software.
• Send spam, unsolicited messages, or engage in deceptive marketing practices.
• Infringe on the intellectual property rights of others.
• Impersonate any person or entity, or falsely represent your affiliation.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems.
• Interfere with or disrupt the Service or servers, including overloading, flooding, or launching denial-of-service attacks.
• Use the Service to track individuals without their knowledge or consent in a manner that violates applicable law.
• Circumvent, disable, or interfere with security features of the Service.
• Use automated scripts or bots to access the Service without our prior written consent, except through our published API.

We reserve the right to disable any short link, suspend or terminate any account, and remove any content that violates these Terms, at our sole discretion and without prior notice.

The Service offers both free and paid subscription plans. By subscribing to a paid plan, you agree to:

• Pay all applicable fees as described at the time of purchase.
• Provide valid payment information to our payment processor.
• Accept that subscriptions will automatically renew at the end of each billing period unless canceled beforehand.

Prices are subject to change with reasonable notice. If you do not agree to a price change, you may cancel your subscription before the change takes effect. Refunds are handled on a case-by-case basis. Contact [email protected] for refund inquiries.

The Service, including all software, designs, text, graphics, logos, and other content (excluding user-generated content), is owned by Lynki LLC and protected by intellectual property laws.

You retain ownership of any content you create, upload, or submit through the Service. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the Service.

If you connect a custom domain or use our white-label features:

• You represent that you own or have lawful authorization to use the domain name.
• You are responsible for maintaining domain registration and DNS configuration.
• You agree not to use custom domains or white-label features for purposes that violate these Terms or applicable law.
• If you offer the Service to your own clients under a white-label arrangement, you remain responsible for ensuring their compliance with these Terms.

The Service allows you to attach retargeting pixels and integrate third-party tools. When using these features:

• You are solely responsible for compliance with all applicable privacy and data protection laws, including GDPR and CCPA.
• You must provide appropriate notice and obtain any required consent from end users whose data may be collected by third-party pixels.
• Lynki is not responsible for data collected by third-party tracking tools that you choose to integrate.

If you access the Service through our API, you agree to:

• Comply with all applicable rate limits and usage guidelines.
• Keep your API keys secure and not share them with unauthorized parties.
• Accept that we may throttle, suspend, or revoke API access for abuse or excessive usage.
• Not use the API to build a substantially similar or competing service.

We do not warrant that the Service will be uninterrupted, secure, or error-free; that any defects will be corrected; or that the results obtained through the Service will be accurate or reliable. You use the Service at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LYNKI LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to Lynki in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Lynki LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.
• Content you create, share, or distribute through the Service.
• Your use of retargeting pixels or third-party integrations.

You may terminate your account at any time by contacting us at [email protected]. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.

Upon termination, your right to use the Service will immediately cease. All short links created under your account may be disabled. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
